Mõtlesin kogu õhtu Margus Rallistele – esimesele mehhaanikute-kursuse sädeinimesele, kes mölakoori madalalaubalise lällamise väljast enese säästmiseks lahkus. Minemas on veelgi parimaid inimesi – mõne õpetaja osa selles pole ka väike.

On behalf of the ALDE group first I want to thank Damien Cottier, the Legal Committee and everyone in the assembly for the substantial draft and discussion we had on the topic.
Russian escalated war of aggression against Ukraine has lasted for almost a year.
This feels like a long time. It is not. For anyone between Russia and Germany this is unfortunately a regular occurrence.
Because there is a tradition of Russian imperial aggressive wars against its neighbors going back to 1918. It’s a hundred years of Russian imperial wars.
Those wars have 2 things in common. One. They have violated international law. Two. The planners, initiators and perpetrators of these wars have never been tried, nor sentenced. There was never a Nürnberg for Russian aggressive wars. And – the victims of these aggressions never saw justice.
There is a sad tradition of impunity of Russian imperial criminals in Europe.
Be it War against Georgia in 1921 or 2008, against Finland in 1939 or Hungary in 1956 or the forcible annexations of the Baltic States in 1940 –
All these wars have been conducted violating international law. All these wars have been fought in violating Geneva conventions meaning ius in bello law of war – and almost all of them have clearly been aggressions, violating ius ad bellum – the right to war – at least since Kellogg-Briand Pact of 1928.
Today we are finally saying, with this report and with our actions from now on – no more impunity for the crime of aggression. No more impunity for crime of genocide, no more impunity for crimes against humanity, no more impunity for war crimes. This is not only important for Ukraine. This is important for Europe and maybe even more important for Russia itself. For the first time in a hundred years Europe is united in breaking the pattern. This will give Russia a hope for change for better.
But as the German foreign minister told us just 2 days ago – Declarations are not enough.
This report outlines some steps that must be taken now to make sure that the criminals in this war will be punished.
We need an International Special tribunal to investigate and try the crime of Aggression. The mother of the war crimes. As the Nürnberg judgement says: war of aggression is not only an international crime; it is the supreme international crime differing only from other war crimes in that it contains within itself the accumulated evil of the whole.
Therefore, its alarming that the World has not been able to agree upon a Court that would have universal jurisdiction over the crime of aggression.
We need to set up a tribunal for Russian aggressors and parallel to this we should reform the ICC system and Rome Statute so that this kind of court would be there in the future.
I particularly welcome the recommendation to immediately set up an ad hoc Prosecutors office for the Special Tribunal even if the Tribunal is not yet formed.
I particularly welcome the recommendation to the 4th Council of Europe Summit in Reykjavik to address the Tribunal issue. Frankly, it should be one of the central topics of the Summit.
I want to know why our own Human Rights Commissioner is not all over this and collect evidence and be vocal.
To sum it up. The report is good. We need to keep pushing this. Freedom of Ukraine depends on victory in war, freedom of Russia depends on ending the vicious cycle of impunity. The future of Europe depends not only on Ukrainian victory but on the end of impunity of aggressors.

DNA AKTIVEERIMINE.
